What Is FSSAI ?
FOOD SAFETY AND STANDARD AUTHORITY OF INDIA (FSSAI) is an autonomous body established under the Ministry of Health & Family Welfare, The Government of India. This authority regulates the quality of food and supervises the standard of food provided in the market. This authority provides food license to the organization dealing with the business of food and its supply in India. The authority registered under Food Safety and Standard Act, 2006 to consolidate the regulations related to the food safety across India. Any person can apply for the food license; the person can be an individual natural person, or private limited company, limited liability partnership, firm, an association of person, other body corporate. If any company’s main activity is related to food preparation or other human consumable items then that entity has to apply for FSSAI registration or license only after company registration as at the time of FSSAI registration the certificate of registration has to be submitted to the government.
It is also known as food license, FSSAI license, food registration. The authority takes care of the public health by framing regulation for the food and its item and by supervision of food safety so that the public get a good quality of food supply. The main responsibility of the authority is to check the quality of the food and grant license if the organization pass the quality check. FSSAI sets the rules and regulations for the organizations dealing in the food sector. Every organization dealing in food business necessary to take food registration or license irrespective of turnover of the business, it is mandatory to apply for the license for every food sector business. If any organization is dealing in Import or Export business for food products then they should apply for the Import Export Code (IEC) along with FSSAI License. If any organization took GST Registration for its business of food including café, dhaba, hawkers, etc. as a proprietorship even then the FSSAI is mandatory. FSSAI License or food license is a certificate provided by the authority that the organization ensure the quality check of food quality and they maintained the quality of food. There are some basic licenses which are required to taken by the business entity which are dealing in restaurant services or hotel services like company registration or LLP registration or proprietorship whichever is required, FSSAI registration and Trademark registration.
Types Of FSSAI
FSSAI Registration Certificate
There are a few category of FBOs who require only Food Registration. No license is required to run their business and these are:
- Manufacturer or seller of food items like; hawker, temporary stallholder, distributor of food except for caterer.
- FBO of food manufacturing, processing including re-labellers & repackers, storage, wholesaler, retailer, distributor, supplier, caterer, restaurant, marketer whose turnover is less than 12 lakh per annum
- Production capacity of food is not more than 100 kg/ltr per day except milk and milk product and meat and meat products
- Procurement or handling and collection of milk is up to 500 ltr per day
- Slaughtering capacity is 2 large animal or 10 small animal or 50 poultry birds per day or less.
- Vegetable oil processing including extraction, refineries and oil expeller unit having installed capacity of up to 12 lakh per annum
- Other FBOs like Dhaba, club, canteen, permanent or temporary stallholder, food stall or arrangement in a religious gathering, or any other food vending establishment having turnover up to 12 lakh per annum
FSSAI Central License
The following FBOs are mandatorily required FSSAI Central License:
- All E-commerce food business
- 5 star and above accreditation hotels
- 100% export oriented units
- All importers who are importing food products including ingredients and additives even for commercial use
- The registered office of FBOs operating in two states or more
- All FBO of manufacturing/processing/importing any proprietory food for which NOC has been given by FSSAI
- Catering services in Central Government Agencies like Railway, Air and Airport, Seaport, Defence etc
- Meat Processing unit equipped to handle or process more than 500 kg per day or 150 MT per annum.
- Slaughter more than 50 large animals, or 150 or more small animals (includes sheep & goats), or 1000 or more poultry birds
- Vegetable oil processing including extraction, refineries and oil expeller unit having installed capacity of more than 2 MT per day
- The dairy unit including milk chilling unit equipped to handle or process more than 50000 ltr of milk liquid per day of 2500 MT milk solid per annum.
- All food processing units other than in point 8 to 11 including repacker and re-labeller having installed capacity of more than 2 MT/day except grains, cereals and pulses milling.
- Transporter having more than 100 vehicles/wagons or turnover more than 30 crores
- Other FBOs like a retailer, distributor, supplier, caterer, restaurant, marketer having turnover more than 20 crores and in case of wholesaler turnover more than 30 crores.
- In case of storage (except controlled atmosphere and cold) capacity more than 50000 MT, storage (cold or refrigerated) capacity more than 10000 MT and storage (controlled atmosphere and cold) capacity more than 1000 MT
FSSAI STATE LICENSE
All the FBOs who are not falling in the above two categories has to file the FSSAI license with the State Authority :
- 3 star and above but below 5 stars and up to 3 star whose turnover is more than 12 lakh
- Catering services in Central Government Agencies like Railway, Air and Airport, Seaport, Defence etc (few areas are excluded)
- Meat Processing unit equipped to handle or process up to 500 kg per day or 150 MT per annum.
- Slaughter more than 2 and up to 50 large animals, or small animals more than 10 and up to 150 (includes sheep & goats), or poultry birds more than 50 and up to 1000/day
- Vegetable oil processing including extraction, refineries and oil expeller unit having installed capacity of up to 2 MT per day and turnover more than 12 lakh
- The dairy unit including milk chilling unit equipped to handle or process 501 to 50000 ltr of milk liquid per day or 2.5 MT to 2500 MT milk solid per annum.
- All food processing units other than in point 8 to 11 including repacker and re-labeller having installed capacity of more than 100 kg/ltr to 2 MT/day except grains, cereals and pulses milling.
- Transporter having up to 100 vehicles/wagons or turnover up to 30 crores
- Other FBOs like a retailer, distributor, supplier, caterer, restaurant, marketer having turnover up to 20 crores and in case of wholesaler turnover up to 30 crores.
- Other FBOs like Dhaba, club, canteen, permanent or temporary stallholder, food stall or arrangement in a religious gathering, or any other food vending establishment having turnover more than 12 lakh per annum
- In case of storage (except controlled atmosphere and cold) capacity up to 50000 MT, storage (cold or refrigerated) capacity up to 10000 MT and storage (controlled atmosphere and cold) capacity up to 1000 MT
FSSAI License Renewal
FSSAI License is valid for minimum 1 year and maximum 5 years and after that, the FBO can renew its license because if FBO fails to renew its license then it will be deemed that the FBO has surrendered its license and after that it will be no longer valid. A renewal application must be filed within 120 days before the expiry of the license but if no renewal application is submitted then the FBO can get the extension 30 after the expiry of license so that a renewal application can be filed. If FBO is filing renewal application after the expiry of license then there is a fine of Rs. 100/- per day as a late fee. To avoid this penalty it is better to file the renewal application within the specified time.

FSSAI Non-Compliance
The following are the non-compliance of FSS Act, 2006:
- Fails to comply with the provision of this act, and rules and regulations made thereunder.
- Providing or selling any unhygienic food or food products
- Doing any misleading advertisement or branding of any food products
- Food and food products contain any extraneous material
- The processing or manufacturing of food is in an unhygienic and unsanitary way.
- The FBO is selling the food which is not as per demand/quality/quantity/nature or substance or the food or any product is sub-standard
FSSAI Penalties
The penalties under FSS act are:
- Non-compliance of this act or the food demanded by the purchaser has bad or unhygienic quality: There is a fine of Rs. 2 lakh on seller Rs. 25000 on petty manufacturer
- Sub-standard food: Fine of Rs. 5 lakh on manufacture, seller, storage, distributor, importer
- Misbranded food: Fine of Rs. 3 lakh on manufacture, seller, storage, distributor, importer
- Misleading advertisement or labelling, or false description: Fine of Rs. 10 lakh on publisher or any person involved in publishing
- Extraneous matters in food: Fine of Rs. 1 lakh on manufacture, seller, storage, distributor, importer
- Fail to comply with FSO direction: Fine of Rs. 2 lakh on FBO or importer
- Unhygienic, unsanitary processing or manufacturing of food: Fine of Rs. 1 lakh on manufacture or processor.

Who needs FSSAI registration?

Do I need different FSSAI license for different states?
Generally, FSSAI license is based upon the turnover of the enterprises, it means which type of FSSAI license you required is dependent upon your business turnover. If the turnover of enterprises is less than 12 lakh then that enterprises required only FSSAI registration but if its turnover is more than 12 lakh but less than 20 crores then it required to register itself under FSSAI State License and under this, its area of operation is limited to a particular one state in which it is registered. Do I need FSSAI license for importing and exporting food items?

What is FSSAI license validity?
The FSSAI License is valid for minimum 1 year and maximum 5 years and it depends upon the applicant that for how many years he wants to apply for the license. The cost of the FSSAI is depended upon the number of years applied by the applicant. After the expiry of the validity of the license, it can be renewed for again 1 year to 5 years.

How long does it take to get the FSSAI license?
FSSAI REGISTRATION: It will take around 8 days to get the FSSAI Registration certificate if no query is raised by the authority within 7 days from the date of filing the application.
FSSAI LICENSE: It will take more than 60 days to get the FSSAI License, if there is no query is raised by the authority within 60 days from the submission of the application then the FBO will get the certificate after the expiry of 60 days but if any query is raised between these 60 days then the time will be extended.
Do I require FSAAI license if I am selling homemade products online?
Yes, the FSSAI license is required for the selling of homemade products whether online or offline. But if such business is a small scale business and the turnover is less than 12 lakh then only FSSAI registration is sufficient there is no need to take FSSAI Central/State License.
What if my business is spread in more than one state?
If the business of FBO has business related with the food and food products in more than one state then the FBO has to apply for the FSSAI Central License for its head/registered office and separate FSSAI State License or FSSAI Registration for other units depend upon their capacity and turnover.
What will happen if I do not renew my FSSAI license?
The renewal should be done on time but if the applicant won’t apply for the renewal of Food license within a given time period then it will be considered as expired. The applicant has to file renewal application within 120 days before the expiry of the license but if he fails to do so then the government has provided 30 days extension after the expiry of license for renewal of the license but if the applicant is filing renewal application after the expiry of license then the applicant has to pay Rs. 100/- per day as a late fee. To avoid this penalty it is better to file the renewal application within the specified time.
Can I transfer FSSAI License?
Yes, but only in case of death of the owner of the certificate holder. It will be transferred to his legal heirs or legal representatives, but first, they have to apply for such transfer to the authority with the support of all the pieces of evidence and documents but the approval of such transfer totally depends upon the authority.
Which types of complaints are addressed to the FSSAI related to food products?

Who needs to file FSSAI annual return?
- A merchant exporter can file its Quarterly annual report through an online system
- FBO of manufacturing milk and milk products shall have to file its half-yearly return in FORM D-2. The FBO needs to submit this form manually to the concerned central/state authority. The FBO has to file this return within a month from the end of the period and the first half-yearly period will be from 1st April to 30th September and 2nd half-yearly period will be from 1st October to 31st
- Manufacturer and Importers have to file an annual return in the form D-1 and this form will be submitted manually to the concerned Central/ State Authority. The form has to file on or before 31st May of each year for each class of the food.
What is HACCP?
Hazard Analysis and Critical Control Point (HACCP) is a plan under which total supply chain of food is covered, it covers b from logistic to the manufacturing, packaging, transportation and the end-use by the consumer. This plan is practice for the production of hygienic food and FBO should adopt this practice to ensure food safety.
Who can use HACCP?
It is used by the Food Business Operator who is dealing food supply chain from logistic, storage, processing, sanitation, maintenance, packaging to the end-use by the consumer. The FBO used this plan for the practice of hygienic food supply among the consumers. By this plan, the FBO get to know which is the weakest point of production so that they can take some preventive measures to avoid unhygienic process between the food supply chain.
What is a restaurant license?

What do you mean by food recall?
Food recall means it is an action under which any food product is removed from the market at any stage of the food chain even if it is under possessed. The Food Saftey Officer has the power to inspect as per the checklist of inspection framed by the Licencing Authority/Designated officer. The authority has to ensure for periodical food safety audit and inspection of the licensed FBOs through the food safety officer.
What is the maximum penalty for violation of rules related to incorrect or misleading labelling on food articles?
If any person violates the rules related to the misleading labelling or advertisement then the person who is involved in it including publisher will be penalized with the fine of maximum 10 lakh rupees.
